Terms of Service
The terms that govern use of this website and engagement of Gached's services.
1. Informational Website Use
This website provides information about Gached's services. Browsing this site does not create a service agreement or any business relationship beyond the use of the website itself. Any engagement of services requires a separate written agreement that defines the specific scope, deliverables, fees, and terms.
2. Service Scope
Gached provides website, Google visibility, local SEO, lead capture, CRM, follow-up automation, review management, Google Local Services Ads support, and practical AI workflow systems for local businesses. The exact scope of any service engagement is defined by the written service agreement reached after the Growth Audit and discovery process. No content on this website constitutes an offer to provide services at a specific price or scope until confirmed in writing.
3. No Guarantee of Results
Gached does not guarantee search engine rankings, lead volume, lead quality, appointments, revenue, advertising performance, or any specific business outcome. Services consist of setup, configuration, support, maintenance, and improvement of systems. Outcomes depend on many factors outside Gached's control, including market conditions, competition, ad spend, business operations, and customer behavior.
4. Client Responsibilities
Clients agree to provide accurate and timely information, grant necessary access to platforms and accounts where needed, respond to reasonable requests during the build process, and pay fees as agreed in the service agreement. Gached is not responsible for delays or issues caused by incomplete, inaccurate, or delayed information from the client.
5. Third-Party Platforms
Gached works with and configures third-party platforms including but not limited to Google, CRM providers, email and SMS services, analytics tools, and AI services. Gached does not control these platforms and is not responsible for their downtime, policy changes, feature changes, data handling, or service interruptions. Clients remain responsible for any third-party fees, terms, and account obligations. Google Local Services Ads ad spend is separate and paid directly to Google.
6. Intellectual Property
Ownership of deliverables, content, configurations, and systems is defined in the written service agreement. Unless otherwise stated in that agreement, Gached retains ownership of its proprietary methods, templates, and workflows. Client-provided content and materials remain the property of the client. Upon completion and full payment, deliverables agreed upon in the service agreement are transferred to the client as specified therein.
7. Payment Terms
Implementation fees cover one-time build work: configuration, migration, copy, integrations, and setup. Monthly fees cover ongoing service, maintenance, monitoring, and improvement of the system. Payment terms, billing cycles, and accepted methods are governed by the written service agreement. Late payments may result in suspension of services as described in that agreement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Gached's total liability arising from any service engagement is limited to the fees paid by the client for the specific service giving rise to the claim. Gached is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost leads, or lost revenue. This limitation applies even if Gached has been advised of the possibility of such damages.
9. Termination
Either party may terminate services as described in the written service agreement. Upon termination, Gached will provide reasonable cooperation to transition access to accounts, content, and configurations as specified in that agreement. Outstanding fees remain due upon termination. Data retention after termination is governed by the service agreement and applicable law.
10. Governing Law
These terms and any service agreements are governed by the laws of the jurisdiction in which Gached operates. The specific governing jurisdiction and venue for dispute resolution will be confirmed in the service agreement and should be reviewed by qualified counsel.
